Our client is a regulated healthcare organization with consumer‑ and customer‑facing offerings. The Legal function partners closely with the business to support commercialization efforts, navigate regulatory requirements, and provide practical legal guidance across a complex operating environment.

The role will function as a senior commercial counsel supporting a variety of business teams and market channels, including direct‑to‑consumer and digital initiatives.

Responsibilities

  • Partner closely with commercial, marketing, and product teams to provide senior-level legal guidance supporting the launch, promotion, and commercialization of healthcare products and services.
  • Advise on legal considerations impacting direct‑to‑consumer, digital health, e‑commerce, and customer-facing offerings, including go‑to‑market strategy, promotional activity, pricing, and distribution models.
  • Provide legal review and counseling on marketing and advertising matters, including development and execution of campaigns, promotional materials, and claims, to ensure compliance with healthcare and consumer protection requirements.
  • Counsel stakeholders on healthcare‑specific regulatory issues affecting commercialization, including healthcare fraud and abuse considerations, consumer protection laws, advertising regulations, and data privacy obligations such as HIPAA and applicable U.S. state laws.
  • Lead the drafting, negotiation, and interpretation of a wide range of commercial agreements with customers, distributors, strategic partners, and technology or service providers.
  • Advise on evolving regulatory requirements impacting healthcare delivery and access models, including considerations relevant to home‑based care, durable medical equipment, and emerging channels to market.
  • Support new business initiatives and strategic collaborations by providing practical, risk‑balanced legal advice aligned with business objectives.
  • Coordinate with legal colleagues across regions or business units to promote consistent, scalable legal guidance.
  • Manage disputes and issues arising from commercial activities, including pre‑litigation strategy and oversight of outside counsel as appropriate.

Requirements

  • Juris Doctor; admitted and in good standing to practice law in at least one U.S. jurisdiction
  • 8+ years of related experience in relevant sectors
